Terms of Service

You must be 18+ and legally authorized to bind your campaign, PAC, party committee, non-profit, or firm. You are responsible for all activity under your account, including that of any team members or resellers you invite. Keep credentials confidential. Notify us of any unauthorized access.

You may not use OS1776 to:

• Send SMS/MMS to phone numbers that have not opted in, or after they have opted out.
• Circumvent 10DLC, TCPA, FEC, or state-level campaign-finance or communications law.
• Upload voter files, donor lists, or PII that you do not have legal rights to.
• If you are a 501(c)(3), engage in prohibited political-campaign intervention. The endorsement guard will block it; do not disable it.
• Impersonate any candidate, official, or organization; publish deepfakes or fabricated official communications.
• Send commercial spam, phishing content, malware, or content that violates any applicable law.

OS1776 may suspend or terminate accounts that violate this section, without refund and without prior notice for material violations.

You own the data you upload or collect through OS1776 ("Customer Data"). We hold Customer Data on your behalf as a processor and only use it to run the Service, respond to your support requests, and meet legal obligations. Export your data any time. Delete requests are irrevocable and cascade within 30 days.

Paid tiers bill monthly or annually via Stripe. Prices, tier features, and included quotas are described at os1776.com/pricing and may change with 30 days' notice on the next renewal. Overage charges (SMS, seats, contacts) apply per the pricing page.

Free tiers may be watermarked, throttled, or restricted; free-tier features may change with reasonable notice.

All fees are non-refundable except as specified in the Refund Policy. Cancellations take effect at the end of the current billing period.

OS1776 uses AI to draft campaign plans, site copy, images, video, opposition profiles, and messaging. You are responsible for reviewing, approving, and legally clearing everything the AI drafts before you publish or send it. AI output is not a substitute for legal, financial, or campaign-strategy advice. Content you generate is yours; you assume the risk of its use.

You are the sender of record for every SMS, call, mailer, email, ad, and donation flow generated through OS1776. We provide compliance guardrails (pre-flight scanner, disclaimer auto-appending, opt-in registry, FEC-format exports) but the legal responsibility for compliance is yours. If regulators ask, our audit logs are available to you.

If you enroll in the Partner program, you may resell OS1776 under your firm's brand. Standard commission is 20% of recurring subscription revenue. Reseller obligations include Stripe Connect enrollment, adherence to the branding rules published in your reseller console, and no false or misleading representations about OS1776's capabilities. Program details are in your reseller agreement.

OS1776 is provided "as is." We disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement) to the extent allowed by law. Elections are inherently unpredictable; we make no guarantee of any electoral outcome.

To the maximum extent permitted by law, OS1776's aggregate liability under these Terms is limited to fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost votes, lost donations, or lost time.

Either party may terminate for material breach on 15 days' notice if the breach is not cured. We may terminate immediately for violations of Section 2 (Acceptable Use) or for non-payment. On termination you may export your data for 30 days; after that, we may delete it.

We may update these Terms. Material changes will be emailed to your account owner at least 15 days before they take effect. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state and federal courts located in Delaware, unless small-claims court is appropriate.
